These Terms of Service (“Terms”) govern your access to and use of the Flowinleads website at flowinleads.com and the lead generation services provided by Flowinleads LLC(“Flowinleads,” “we,” or “us”). By submitting a contractor application, accepting leads, or otherwise using our services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old, legally able to enter into a binding contract, and operating a legitimate trade or service business in the United States to use Flowinleads. By using the Services, you represent and warrant that you meet these requirements.
2. Description of the Services
Flowinleads connects local trade and home-services businesses with homeowners and facility managers who have submitted requests for their services (“Leads”). After your contractor application is approved, we will send Leads matching your trade and service area to you via SMS, email, and/or phone. Each Lead is sent on an exclusive basis to a single contractor.
3. Lead Pricing and Payment
Flowinleads operates on a pay-per-lead basis. The price per Lead depends on your trade, service area, and selected plan, and will be confirmed in writing before your account is activated. There are no retainers, setup fees, or long-term commitments unless explicitly agreed in a separate written agreement.
You agree to pay all charges associated with the Leads we deliver to you in accordance with the payment terms confirmed during onboarding. Past-due amounts may result in suspension of Lead delivery.
4. Lead Quality and Replacement Credits
We make commercially reasonable efforts to deliver high-intent, verified Leads. If a Lead is fraudulent, has invalid contact information, requested a service we do not cover, or otherwise meets our published criteria for replacement, you may request a replacement credit by notifying us within 48 hours of receiving the Lead. Approved replacement credits will be applied to your next billing cycle.
Flowinleads does not guarantee that any specific Lead will result in a closed job, sale, or any particular outcome. Closing rates depend on your sales process, response time, pricing, and other factors outside our control.
5. Acceptable Use
You agree that you will not:
- Resell, share, or transfer Leads to any third party;
- Use Leads for any purpose other than offering and providing the services described in your application;
- Contact Leads in a manner that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any other applicable federal, state, or local law;
- Misrepresent your business, licensing, insurance, or qualifications;
- Attempt to reverse-engineer, scrape, or interfere with the Services or our systems.
6. Cancellation
You may pause or cancel your account at any time by contacting us at hello@flowinleads.com. We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct that we determine harms Flowinleads, other contractors, or the Leads we serve.
7. SMS Communications
By providing your phone number and consenting to SMS messaging, you agree to receive recurring text messages from Flowinleads about your account and Leads. Message and data rates may apply. Reply STOP to opt out, HELP for help. See our Privacy Policy for full details about our SMS program.
8. Intellectual Property
The Site, our brand, and all content provided by Flowinleads are owned by Flowinleads LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Site and Services for the purpose of receiving and acting on Leads.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any specific number of Leads will be delivered.
10. Limitation of Liability
To the maximum extent permitted by law, Flowinleads, its affiliates, and its service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to Flowinleads in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Flowinleads and its officers, employees, and agents from any claim, liability, or expense arising out of your use of the Services, your contact with any Lead, or your violation of these Terms or any applicable law.
12. Governing Law
These Terms are governed by the laws of the State of AZ, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Phoenix, AZ, and you consent to the exclusive jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and update the “Last updated” date above. Your continued use of the Services after the changes take effect means you accept the updated Terms.
